Daryl Weinman, Austin Divorce Lawyer

Board Certified in Family Law by the Texas Board of Legal Specialization

Divorce is one of the most stressful and risky events in a person's life. At the law office of Morehart & Weinman, I understand what clients are going through. As a divorce attorney, a daughter of divorced parents, and a step-mother myself, I have a true understanding of my clients' concerns, anxieties, and needs. I protect your legal position, provide you with the information you need to make well-informed decisions, and help you negotiate the process of divorce with dignity and respect. To discuss your situation and your needs with me in person, contact my Austin law office and schedule a consultation.

There are many legal factors involved in the dissolution of a marriage, generally in two categories:

  • Decisions which affect the welfare of your children - child custody, child support, visitation, etc.
  • Decisions which involve the financial relationship between you and your spouse - property division, debt allocation, alimony, etc.

It is always best if, through negotiation, mediation, or collaborative divorce, you and your spouse are able to work out a reasonable agreement on these issues rather than having a judge make decisions for you in a trial. If, however, your spouse is unwilling to negotiate a fair resolution in good faith, it is necessary to prepare a strong case to protect you and your children.

Protecting Your Parental Rights and Your Children

If you have children, the factors affecting family relationships and the welfare of the children are your primary concerns: child custody, visitation, and child support arrangements, the possibility of relocation out of state, concerns about international abduction, and grandparents' rights. Texas child custody law always requires any agreement or petition to demonstrate that the requested action is in the best interests of the children.

Protecting Your Financial Interests

The financial aspects of dissolution of marriage should be considered carefully from the time you first a consider divorce. I have a background in finance which enhances my understanding of complex financial issues that may arise. This knowledge enables me to consider not only the immediate value of each asset or payment, but the tax implications and the long-range value. This comprehensive understanding has enabled me to effectively help clients with all financial issues within the divorce, such as: applying for a temporary restraining order to protect joint assets, advising on the equitable distribution of marital assets, identifying community property, alimony (spousal support), and child support.
