Child Custody

Daryl Weinman, Austin Child Custody Lawyer
Board Certified in Family Law by the Texas Board of Legal Specialization

Nothing is more important than your child. If you are involved in divorce, you are acutely aware that your family relationships are changing.

I understand your concerns – I have myself gone through the process of divorce as a child and as a step-parent. During divorce and custody hearings, I will help you remain focused on the best interests of your child. In almost every case, this means working out an agreement with your spouse through negotiation or mediation. You will have to work together for years to come as co-parents, and your child can easily be injured during the public, adversarial process of a trial.

If you would like to meet with me to discuss child custody and visitation, contact my Austin, Texas, family law firm.

Child Custody Law in Texas

Texas family law favors joint managing conservatorship, an arrangement where both parents participate equally in decisions about their children regarding religion, health care, and education. Generally, one parent becomes the primary conservator, while generous visitation is awarded to the non-custodial parent. It is rare for joint custody to be awarded in a way that actually divides the child’s time equally between two residences, and it is equally rare for the courts to name one parent sole managing conservator, denying the second parent any part in the child’s life.

Child Visitation

At my family law office in Austin, as a child custody lawyer trained in mediation and collaborative law, I am able in most cases to help parents work out an agreement on custody, visitation, and child support that preserves, and in some cases enhances the child’s interaction with each parent. I always encourage the non-custodial parent to take every opportunity to be involved in their child’s life, extending weekday visitation from school pick-up to school drop-off and using the opportunity to get to know teachers and staff at the school, coaching a sports team, and using webcams or a Blackberry to ensure daily contact. If you have trouble getting cooperation from your ex-spouse or your child’s school or day-care provider, I will help you assert your parental rights.

Out-of-State Relocation

Texas has recently revised statutory requirements regarding relocation of children out of the state. It is important to work with an experienced child custody attorney to see that your case is presented in a way that clearly identifies the best interest of your child.
